III.16 On what grounds can he be dismissed?
The Prosecutor General removes the prosecutor from
office provided that:
- the prosecutor was found incompetent to carry out legal acts or his competence to carry out legal acts was limited as a result of a final decision made by the court of law;
- the prosecutor ceased to be Slovak national;
- the prosecutor has been validly sentenced for having committed a malicious crime;
- the disciplinary commission made a final decision to expel the prosecutor from the profession;
- the prosecutor has became a member of a political party or of a political movement; or
- the prosecutor does not permanently reside in the territory of theSlovak Republic .
The Prosecutor General may remove the prosecutor from office provided that:
- for a period more than one year, the prosecutor’s health condition as described in a medical report or as decided by the State Health Administration authority or the Social Security body hinders a due performance of prosecutor’s duties and obligations. However, the preceding sentence does not apply to a pregnant prosecutor;
- the prosecutor has attained the 65 years of age.
