III.16 On what grounds can he be dismissed?
Public prosecutors cannot be transferred,
suspended, retired, dismissed or have their situation altered in any way,
unless the cases provided for in the Act apply (sect. 78 Statute of the prosecution
service).
In particular, following disciplinary proceedings for whose imposition the High Council for the prosecution service is competent, the penalties of suspension from duty, removal from active list, compulsory retirement and dismissal, among others, can be imposed on public prosecutors (sects. 27(l)(a) and 166 Statute of the prosecution service).
