I.35 Who has the right to withdraw the charge?
Withdrawing the charge becomes relevant only when
the criminal proceedings depend upon complaint.
In this case only the victim, i.e. the person holding the interest whose protection is specially aimed at by the law through the charge, has the right to request respective withdrawal (sect. 51(1) CCP).
