I.25 For a decision referred to in question 16, does the prosecutor need consent from others?
The public prosecutor does not need consent from
any other party for the decision of non-prosecution, prosecution under summary
procedure or simplified procedure.
In case of a decision of provisional stay or if it requests the imposition of a sanction under extra-summary procedure, it is necessary to obtain the consent or the non-opposition of the parties.
