I.18 What are the main technical/legal reasons?
For example, the case is discontinued where
sufficient evidence has been collected supporting either the non-existence of a
crime or the conclusion that the alleged offender did not commit it; the proceedings
are not legally admissible, in particular due to over passed statutory limits;
the extinction of the right to lodge a complaint or the lack of legitimacy
thereto, in cases where the criminal prosecution depends on complaint (sect.
277(1) CCP).
The case is also discontinued where it has not been possible to gather sufficient proof on the existence of a crime or on the particulars of its offender(s) (sect. 277(2) CCP).
