IV.10 Can a public prosecutor join a political party?
A public prosecutor can join a political party and
can be an active member of the party. It has happened that members of the prosecution
service were elected as Member of Parliament. Membership of Parliament is
incompatible with the function of public prosecutor. After his election as
Member of Parliament, the public prosecutor is de jure considered to be a non-active member of this prosecution
service (The Incompatible National and European Parliaments’ Memberships Act, sects.
1 and 2).
