I.30 Who decides on a charge in the indictment?
The bill of indictment is the sole responsibility
of the Attorney General and/or any public prosecutor so delegated by the same
Attorney General. The only limit that exists relates to the fact that no
charges may be brought in the bill of indictment unless the offence/s result
from the actual compilation of evidence, i.e. the criminal inquiry.
