I.23 If the prosecutor himself does not take the decision, then who does?
Decisions on non-prosecution for technical/legal
reason and on simplified procedures may be taken by a public prosecutor
himself. Decisions on non-prosecution and on diversionary measures have to be
taken by the Attorney General himself and the Executive, and by the Director of
the Fisheries Department and the Chairman of the Malta Environment and Planning
Authority respectively.
