I.4 Which possibilities exist to regulate the influx?
Since no organic link exists between the
Prosecution service and the police, the Prosecution service is not in such a
position. Furthermore no obligation exists upon the police to report all or any
criminal offence to the Prosecution Service and no penalties exist for not
doing so. By way of conclusion it must also be noted that the decision to
charge an individual for having allegedly committed a criminal offence rests
solely with the police and not with the Prosecution service when dealing with
crimes liable to a punishment of less than ten years imprisonment.
