I.15 Does the prosecution service have the power to give instructions to the police, which cases have to be further investigated and which cases have to be discontinued?

Yes, but only within the limits set by the legality principle. The instruction can be based on the existence or non-existence of the prerequisites of further criminal proceedings. If the prosecutor deems that the case is not yet sufficiently clear, he instructs the police on additional investigative actions. On the other hand, when existence of grounds for dropping the case due to either technical or other reasons is established, or the case is proper for submitting the indictment, the prosecutor may instruct the police to conclude the investigation.
