Questionnaire Hungary
I.10 Can the public prosecutor be involved in the police investigation process from the moment it started up?
Yes, he may, but it does not mean that he is
necessarily involved in the investigation from its commencement in every case.
The investigating authority shall notify the prosecutor within twenty-four
hours that a formal decision to initiate an investigation has been taken.
It is up to the prosecutor whether he reacts to the notification actively or lets the case go without his involvement. In practice, it depends
on the complexity and significance of the case (see Q 12-13).
