I.1 Do the police have powers to channel an offence aside without further involvement of the criminal justice system?
As the criminal procedure is governed by the
legality principle (mandatory prosecution), the police do not have the power to
channel an offence aside without further involvement of the criminal justice system.
The police may ‘reject a report’, which means dropping the case without any
investigation, only on technical grounds (the reported behaviour does not
constitute a criminal offence, there is no suspicion of a crime, res judicate
etc.)
