I.37 What happens with the case after the withdrawal of the charge?

If the accused is acquitted or discharged, he must immediately be set free, unless he has been detained for another reason (sects. 367 and 471 CCP). Public prosecution for the imposition of a penalty is then extinguished by res judicata.
