I.34 Can the charge/indictment be withdrawn while the case is pending in court?

If the court considers that the matters prosecuted do not constitute a criminal offence or are not proved, or not imputable to the defendant, it dismisses the prosecution (sects. 470 and 516 CCP). The competent court then pronounces the discharge of the accused person.
