I.31 Which judge and what procedure is applied?

Where a preliminary judicial investigation is made compulsory by the law or is requested by the district prosecutor, the investigating judge can decide on the charges not covered by the prosecution submissions according to sect. 80 CCP, and pass on forthwith to the district prosecutor the complaints or the official records which establish their existence.
