I.27 In case of non-prosecution for technical or legal reasons, who needs to give his consent?
No-one needs to give consent. The district
prosecutor alone is entitled to decide whether an offence should be transmitted
to the investigating judge or to the competent judging court or not, this as a
result of the expediency principle and his control over legality of the prosecution.
