I.27 In case of non-prosecution for technical and legal reasons, who needs to give his consent?

Sect. 200 CCP states that if circumstances specified in § 199 CCP which preclude criminal proceedings (technical and legal reasons) become evident in pre-trial proceedings, the proceedings shall be terminated on the basis of an order of the investigative body with the permission of a Prosecutor’s Office, or by an order of a Prosecutor’s Office. Pursuant to sects. 207 and 208 CCP, the victim can appeal against such decision of non-prosecution.
