Questionnaire Estonia

I.14 Does the prosecution service have the power to decide on the scope of the police investigation?

The prosecutor has the possibility to intervene in an investigation and to decide on the amount of evidence. For example, in cases of non-prosecution due to the minor nature of the offence and lack of public interest (sect. 202 CCP), the police and prosecutor can negotiate on the amount of evidence necessary to prove that an offence has been committed.
