I.8 What are these grounds?

According to sect. 153 CCP police have to prepare the summary of pre-trial proceedings, which contains evidence of the probable offence committed. Based on this summary, the prosecutor formulates a charge or decides to waive prosecution (sects. 223 and 226 CCP). The prosecutor can also order police to carry out additional investigations as to present the necessary evidence on which a decision whether or not to prosecute can be based.
