III.3 In which law?
Whereas the independence of the judiciary is laid
down in sect. 64 Constitution, including a rule that judges can only dismissed
by judgment in ‘The Special Court of Complaints’, Klageretten, the prosecution
service has no corresponding independence. It has been mooted that at least the
Attorney General ought to enjoy independence, but nothing has come of it. On
the other hand, arbitrary dismissals are unheard of in the government service.
Practically speaking, the prosecution service acts as if it had independence.
