I.34 May the charge/indictment be withdrawn while the case is pending in court?

Public prosecutor can withdraw the indictment (not only charge) till the court of the first instance is starting final session. After starting proceedings before court can to do it only if defendant does not want to continue criminal proceedings. The Criminal Procedure unifies charge and indictment at the moment of the end of preliminary proceedings in one document – indictment.
