II.1 Does the prosecution service participate in the preparation of a policy on criminal law enforcement?

General policy matters regarding enforcement fall within the authority of the executive. For example, the Ministry of Justice and Public Order may decide to promote new legislation regarding the treatment of juvenile offenders. Such legislation is prepared by the Ministry and, through the prescribed procedures, it is submitted to Parliament. The participation of the prosecution service in this process is not a legal pre-requisite. However, in practice, the prosecution service is very often consulted by the executive and the suggestions of the Attorney General are seriously taken into account.
Furthermore, if the prosecution service traces any inadequacies or gaps in the criminal justice system, they bring the matter to the attention of the Ministry together with concrete suggestions for legislative amendment. Therefore, I would answer the question in the affirmative, always subject to what has already been said.
