The Role of the Public Prosecutor in relation to the Execution of Sanctions
The prosecution service has no tasks or responsibilities in relation to the execution of sanctions in principle.
Once judicial proceedings are concluded and the accused is sentenced, the role of the prosecution service ends. The execution of sanctions is a task imposed by law on other authorities. For example, the administration of prisons and all matters relating to prisoners come within the province of the Ministry of Justice and Public Order.
The only matter in which the Attorney General is involved is the exercise of the power to grant pardon. According to the express provisions of sect. 54 Constitution, the power to remit, suspend or commute any sentence passed by a court is granted to the President of the Republic. However, the Attorney General may exercise this presidential prerogative only upon a recommendation.
