I.30 Who decides on a charge in the indictment?

The public prosecutor. The accused may lodge an objection (Anklage-einspruch) against the charge within fourteen days after accusation. This objection will be dismissed by the investigating judge, f.i. if it has been raised too late. The decision on the objection lies within the competence of the court of appeal.
